A 45-year-old Canóvanas man has been arrested on a six-count federal indictment alleging the production, receipt, transportation and possession of child sexual abuse material, including alleged conduct involving a 3-year-old boy and another prepubescent boy.
Homeland Security Investigations agents arrested David Ortiz-García on August 25, five days after a federal grand jury returned the indictment. The U.S. Attorney’s Office for the District of Puerto Rico announced the case on September 8.
Allegations in the indictment
According to the Justice Department’s description of court filings, Ortiz-García allegedly possessed and knowingly accessed child sexual abuse images and videos from approximately November 2025 through July 2026 using a phone and other internet-capable devices. Prosecutors say the files included depictions of toddlers, prepubescent children and children younger than 12.
The indictment further alleges that between January 9 and January 12, 2026, Ortiz-García induced, enticed or coerced—and attempted to induce, entice or coerce—a 3-year-old boy to engage in sexually explicit conduct for the purpose of producing an image. Two additional production counts concern alleged conduct involving a prepubescent boy in February and April. The remaining charges include receipt and transportation of illegal material.
These assertions are allegations, not findings of guilt. Ortiz-García is presumed innocent unless prosecutors prove the charges beyond a reasonable doubt.
Potential penalties and investigation
Each production count carries a mandatory minimum sentence of 15 years and a maximum of 30 years if convicted. Receipt and transportation each carry five-to-20-year ranges, while possession can carry up to 20 years. Any sentence would be determined by a federal judge under the statutes and advisory guidelines.
The Puerto Rico Crimes Against Children Task Force, led by HSI, investigated. Assistant U.S. Attorney Daynelle Álvarez-Lora is prosecuting. Officials emphasized that child victims do not fit a single gender profile and said investigators have observed adult men targeting boys.
What remains unresolved
The public announcement does not identify a trial date, describe a defense response or say whether Ortiz-García has entered a plea. It also does not disclose whether the children are now safe or whether investigators believe additional victims exist. Those gaps should not be filled by inference, and the children are not identified here.
